1. Refundable Bond
A Refundable Bond may be required for hired items. This will be refunded if the items are returned in good condition and working order. If items are returned unclean, damaged, missing, or stained, Scene & Co. will retain the bond. Refunds will be processed within 7 days of item return.
2. Payment
Full payment must be made 7 days before collecting or having equipment delivered, unless agreed otherwise. Customers may take equipment on the day of collection, but the invoice must be paid within 2 working days. If hire charges exceed the initial fee, the balance is due immediately upon return. Late payment will incur a fee of 0.08% per month from the due date.
3. Delivery and Collection of Equipment
Customers authorise Scene & Co. to enter their property for delivery and collection of hired items. We will take care to avoid damage, but we aren't responsible for any damage to driveways, lawns, or underground services.
Customers must be present at the delivery location to confirm receipt of items. If not present, Scene & Co. may charge $29.00 per person per hour for delivery waiting time.
Customers are responsible for checking items upon delivery or pick-up. Claims for shortages or issues cannot be accepted after the customer has taken possession. If the customer is unavailable, they cannot dispute the condition or quantity of items recorded by Scene & Co. at return.
4. Insurance
Customers are responsible for insuring hired items for the duration of the hire, including during transport to and from Scene & Co. Customers must indemnify Scene & Co. against any damage, loss, or theft while in their care.
5. Customer Responsibilities
Customers must take proper care of hired items and indemnify Scene & Co. against any loss or damage. They must reimburse Scene & Co. for any damage or loss immediately after the hire ends.
If customers find that items are not working or have faults, they must notify Scene & Co. immediately. If notified at the end of the hire period, no compensation will be offered. If an inspection is requested and no fault is found, the customer may incur additional labour and transport costs.
Hired items are not guaranteed to be new but will be in good condition and fit for normal use. Items must be returned clean; otherwise, a cleaning fee will apply. For stained items, the cleaning fee may equal replacement costs plus any extra costs incurred.
6. Damage to Property and People
By hiring items, customers accept responsibility for any loss or damage to property or injury to people resulting from the use or operation of the hired items, and indemnify Scene & Co. against any claims.
7. Loss or Damage of Equipment
Customers accept full responsibility if hired items are lost or damaged beyond repair while in their care. They will be liable for the full replacement cost and any additional costs incurred.
8. Cancellation of Hire
If a customer cancels a booking, the following fees apply:
If cancelled more than 90 days before delivery/event date, only the Booking Fee will be withheld unless the date is rebooked.
If cancelled within 90 days, 50% of the Entire Booking will be withheld.
Cancelling within 14 days of delivery/collection incurs full hire costs.
Additional fees may apply if Scene & Co. incurs costs for transport or loading.
9. Scene & Co.'s Right to Terminate Hire
Scene & Co. may terminate hire at any time, providing a reason verbally or in writing. We are not responsible for any loss the customer claims to have suffered due to termination.
10. No Assignment of Equipment or Agreement
Customers cannot sublet hired items but may allow their employees to use them in accordance with this agreement.
11. Acceptance of Terms & Conditions
If a customer does not sign the invoice, their payment of the 20% Booking Fee or collection of hired items will indicate acceptance of these terms and conditions.
12. Last-Minute Additions or Changes
Customers are welcome to make last-minute additions or changes to their booking. However, any modifications requested within 90 days of the event must not exceed a reduction of 20% of the total hired items. This ensures that we can accommodate your changes while still maintaining the quality and availability of our services.
For example, if your total hire amount is $1,000, any changes must result in a new total that is no more than $800. Changes may include adding or removing items, adjusting quantities, or altering delivery details.
Please note that all requests for changes will be subject to availability, and additional fees may apply for any new items added. We recommend contacting Scene & Co. as soon as possible to discuss your requirements and ensure we can meet your needs.
